  • ALERT: On September 26, the United States Court of Appeals for the Ninth Circuit released its ruling in the ATA vs. Port of LA case which overturns the employee mandate requirement that was adopted by the Port of LA in the Port's Clean Truck Program. (9/27/11) IANA had filed an amicus brief on this proceeding last year in support of the ATA position. The Court found that "while the Port may impose conditions on licensed motor carriers seeking to operate on Port property (such as safety or emissions requirements), it cannot extend those conditions to the contractual relationships between motor carriers and third parties." The Court did uphold several other aspects of the Port's concession program, including issues such as off-street parking, maintenance and financial capability.   • FMCSA seeks comments on No Defect DVIR (Driver Vehicle Inspection Report) for intermodal equipment. Comments due August 8, 2011. (6/7/11): The Agency proposes to delete the requirement for drivers operating intermodal euipqment to submit and intermodal equipment providers to retain driver-vehicle inspection reports when the driver has neither found nor been made aware of any defects on the intermodal equipment used.

  • IMPORTANT DVIR/ROADABILITY Regulatory Information – No Defect DVIR (5/20/11): On August 20, 2010, the Federal Motor Carrier Safety Administration announced that it would extend the compliance date, with respect to the No Defect DVIR submission requirement for intermodal equipment, outlined in section 390.42 (b) covered by the roadability regulations, until June 30, 2011. FMCSA has announced today a further extension for compliance until June 30, 2012.

  • Proposed Rule: EOBR & HOS (5/10): The Federal Motor Carrier Safety Administration proposes to amend the Federal Motor Carrier Safety Regulations to require certain motor carriers operating commercial motor vehicles (CMVs) in interstate commerce to use electronic on-board recorders (EOBRs) to document their drivers' hours of service (HOS). Under this proposal, all motor carriers currently required to maintain Records of Duty Status (RODS) for HOS recordkeeping would be required to use EOBRs to systematically and effectively monitor their drivers' compliance with HOS requirements. Until an effective date is established through the Federal Register, DVIRs for all equipment returned to an IEP are required.

  • FMCSRs Not Yet Updated on FMCSA Web site (7/26/10): The Federal Motor Carrier Safety Administration Web site containing the FMCSRs has yet to be updated to reflect the addition of the "roadability" rules within the regulations.
